Art N Soul Escapes, LLC (hereinafter referred to as “ANSE” “our” “us”). Please review these terms in detail as by purchasing any travel product or service you agree you are entering into a contractual relationship with ANSE. This contract is between you and all persons named on the booking, and us. No other person shall have any rights to enforce any of its terms.
These terms and conditions (“Terms and Conditions”) govern the relationship between Art N Soul Escapes LLC d/b/a Art N Soul Escapes (“ANSE” and/or “we/us/our”) and you, the purchaser or traveler (“Client” and “passenger” and “you/your”). By planning travel with ANSE, you agree to be bound by these terms and acknowledge that ANSE acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services. These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to ANSE. Access to and the use of any other site, product, or service, including those referenced herein or linked to via this website, are governed by separate agreement related to that service or site.
USE OF ANSE SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS
You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with ANSE. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with ANSE and its Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.
ANSE accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through ANSE, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.
ANSE is not liable or responsible for any arrangements made independently of ANSE. ANSE assumes no responsibility for costs or fees you incur for independent arrangements not booked through ANSE, inclusive of, but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, ANSE is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist you with any schedule changes or delays related to air reservations you have made on your own arrangement. It may not be possible to earn frequent flyer or other loyalty points for reservations on your itinerary. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by ANSE.
ANSE is a California Seller of Travel #2158213-50. Registration as a seller of travel does not constitute approval by the State of California.
All formal communications are done via your email used at booking. You are responsible for saving us at a known contact to avoid missing emails due to your email provider moving our messages to spam. Any requests for changes to your trip must be sent to us via email at info@artnsoulescapes.com for changes to your trips are all done via email to ensure clarity.
Travel to certain destinations may involve greater risk than others. Art N Soul Escapes, LLC urges customers to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at:

The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/

INDEPENDENT AGENT OPERATIONS
Potential clients in need of travel services are free to select any affiliate agent that best matches their travel needs and preferences. Each affiliate agent hosted by ANSE operates as an independent contractor and maintains their own brand and business operations. They leverage the support, training, partnerships, and tools provided by ANSE while operating their travel services. We encourage each client to refer to each agents' specific terms and conditions prior to selection, as there may be differences in business operations. At times ANSE may forward potential leads to its affiliate agents that have come through our website based on the agent's niche or specific client requests; however, the responsibility is on the client to decide if they would like to enter into an agreement with that contractor. The parties involved should conduct their own due diligence and make independent decisions, as ANSE is not a party to any agreements or transactions between the client and the independent contractor. The business conducted is solely between the independent contractor and the client, and ANSE assumes no liability for any such dealings.
NON-REFUNDABLE RESEARCH & DESING PLANNING FEE
Advance Research & Design Planning Fees will be charged prior to services being performed in accordance with the individual Advisor’s Fee Schedule as provided to the Client/Traveler. Planning Fees remitted by Client/Traveler to ANSE are non-refundable and non-transferable once paid to ANSE. ANSE or its affiliate advisors may elect to offer a refund of Planning Fees to a Client/Traveler at their discretion based on that client’s/traveler’s individual circumstance. Please be sure to refer to each independent contractor's terms in conditions, when not booking directly with ANSE.
PRICING
All trip prices are correct when posted at the time of booking and are subject to availability and may change without notice. We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. Please check the trip details to see if airfare is included or not. Trips are priced per person, based on shared occupancy. *Single rooms may be available at an additional cost and the prices will be listed where applicable. We advise all travelers to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares and additional late booking fees.
ANSE reserves the right to correct pricing and re-invoice Clients in the case of human or computer error.
You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through ANSE. By submitting a credit card authorization form to ANSE, you agree to allow ANSE to use your payment method to purchase travel products from our Suppliers on your behalf.
If you are using our payment plan option, you must submit a non-refundable, non-transferable, per person deposit (specified deposit will be listed on trip detail page and/or invoice) at the time of booking to reserve your space.
FORMS OF PAYMENT: ANSE accepts all major credit cards, debit cards, and wires for payments. Payments made within 30 days of departure must be made by credit or debit card. Third-party credit cards are not accepted. Payments made by wire transfer must include an additional $25 wire transfer fee.
DEPOSITS: A deposit is due at the time of booking. All deposits are non-refundable and non-transferable. All reservations (except where specified) will require a deposit and will be clearly noted the amount due and monthly payment plan. Roommates (if applicable) will need to pay their deposit within 24 hours of ANSE receiving your reservation in order to secure your reservation.
PAYMENT ARRANGEMENTS AND TERMS: All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations.
As a courtesy, ANSE may offer payment plans for our travel packages and events. Monthly payments commence the month following the initial booking, on the same day the deposit was paid. A minimum payment is required each month on the date specified in your contract. The contract is considered the agreement entered into once payment has been applied to any travel package or event provided by ANSE.
By entering into a payment arrangement with ANSE, you agree to adhere to the payment terms outlined in your contract upon applying your deposit. It is understood that experiences with other agents outside of ANSE do not exempt you from complying with ANSE's payment schedules, as each agent and/or agency operates with its own distinct business practices.
While our system sends courtesy reminders about upcoming payments, it is your responsibility to ensure your payments are made in a timely manner. You are accountable for the successful processing of your payment and for keeping your card information up to date, regardless of whether a payment reminder is received. You may contact us to change your payment date after booking prior to 72 hours of your payment date.
AIRLINE TAXES AND FUEL SURCHARGES: Prior to final payment the tour price may be increased due to reasons outside our control due to increases in government-levied taxes and fees and/or fuel surcharges. To avoid potential increases, you may choose to accelerate your final payment in order that your tickets may be issued.
DECLINED PAYMENTS: Payment plans require monthly payments, with all payment plans defaulting to payments every 30 days. Clients are responsible for ensuring their monthly payments are processed successfully. It is common for a payment to be declined by your bank for various reasons unrelated to the availability of funds. If your bank declines a monthly payment, you will be notified via email.
In the event of a declined payment, we will attempt to process the payment on two consecutive days, notifying you via email each time. You then have 48 hours to respond to the email and update your payment information. If the third attempt to process the payment fails, an administrative late fee will be charged, and your booking may be subject to cancellation if not received 5 days after payment due date.
Traveler understands and agrees to satisfy their balance in full no less than 90 days prior to the date of departure (unless otherwise stated). Should traveler fail to submit the final payment 60 days out, a 10% late fee will be assessed each day based on the original amount. If any traveler fails to reconcile their balance prior to 60 days of departure, their trip will be automatically canceled.
LATE/MISSED PAYMENTS: AND ADMINISTRATIVE FEES Late payments will be assessed an administrative fee of $25/per instance received 5 days after payment due date. Once you miss two consecutive monthly payments your trip is subject to cancellation, and you will forfeit all monies. Once your trip is cancelled you will be notified via your email and your slot will become eligible for the next person on the waiting list (if applicable).

Except in case of fraud against ANSE, you agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of ANSE or its Suppliers, including cancellations or changes of itinerary or arrangements for reasons beyond the control of ANSE or its Suppliers. If you attempt to chargeback, reverse, or recollect a previously authorized trip payment, ANSE reserves the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection, including, without limitation, attorney fees.
ANSE is not liable for any fraudulent acts or transactions committed by its affiliates and/or independent contractors. Any charges or claims against these individual parties or entities will not hold ANSE liable for any transactions not directly made by ANSE.
You have 24 hours from the time of booking to cancel a trip for a full refund. After 24 hours, the trip deposit and all future payments become non-refundable. Penalties and fees may be incurred for cancellations, transfers to another person, or changes in the travel date after this period.
ANSE does not have control over the form of refund issued by certain airlines and travel suppliers. Some travel suppliers may not provide refunds in cash or credits. Many airlines may issue travel vouchers as a method of refund. We highly recommend reviewing the refund policies of your designated supplier prior to booking for policies with or without insurance.
If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. However, certain bookings may not be changeable, and you will be responsible for any additional costs imposed by the Supplier, as well as any change fees from ANSE or the Supplier. All requests for changes to a booking must be made in writing to ANSE. When tour, cruise, or package prices are based on Suppliers’ contract rates, no refund will be provided for any unused portion of travel.
REINSTATING A CANCELLED TRIP: If your trip is cancelled due to non-payment, You may reinstate your trip within 14 calendar days of cancellation by paying the full amount past due and a $250 reinstatement fee.
“Force Majeure” means, in relation to Art N Soul Escapes LLC, any circumstances beyond the reasonable control of Art N Soul Escapes LLC, (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).
Art N Soul Escapes, LLC shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
Life can be unpredictable. Even the best-planned trips can be impacted by the unexpected. And that is why we recommend that you help protect yourself and your investment by purchasing Travel Protection. Travel insurance is not required but strongly recommended.
All ANSE proposals will include trip cancellation coverage, unless denied in writing at time of booking. If you decline to purchase insurance, ANSE may require that you execute an insurance waiver. Trip insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your trip for any reason, whether voluntarily or as a result of Art N Soul Escapes actions.
IMPORTANT: Travel protection plans generally do not cover losses related to COVID-19, including due to government-imposed travel bans or other travel restrictions related to COVID-19.
Please do your own due diligence and select a supplier that fits your travel needs. There are many to choose from. We recommend purchasing cancel for any reason insurance because it will allow you to do just that. However, purchasing this type of policy is time-sensitive and is recommended to be done at the time of booking to ensure you receive the full benefit of the plan. ANSE is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured's existing insurance coverage.

When booking a vacation package for double occupancy, roommates must have their payments in within 24 hours of one another. Otherwise, there is a possibility you may not be on the same flight(s).
When flights are included, they will be booked in the order the appropriate deposits are received. Packages which include flights are not guaranteed to travel on the same flights. There may be instances when the group has to be split up in order to keep the package prices the same. However, we will do our best to make sure no one travels alone.
Any changes in occupancy done post booking will be done at the current pricing available.
Occasionally, we may offer discounted pricing based on inventory which is not retroactive to previously purchased bookings.
As Art N Soul Escapes’ tour prices are based on contract rates, there will not be any refund for any unused portion of a tour. Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed or the tour may be canceled.
By request, we will attempt to pair you with another client, of the same gender, who also needs a roommate as a courtesy. However, if 90 days before your trip, you do not have a roommate; you will be required to pay the single occupancy supplement for your trip, and your balance will be updated to reflect the new occupancy.
We are not responsible if roommate situations do not work out. We highly suggest you make contact with the proposed roommate within 72 hours of notification before any changes occur.
If a disapproval is not received in writing, your agent will proceed with the roommate matching.
Roommates must complete separate registration forms and submit their deposits within 24 hours of one another in order to secure a reservation if they intend on paying separate deposits.
Once the registration forms and deposit is received each roommate can make their monthly payments by the specified payment due date.
You are solely responsible for obtaining any documents required for your participation on the Trip such as a valid passport, all visas, vaccination certificates, and any other documents which may be required by your itinerary or as required for traveling with minors and complying with any destination specific requirements or restrictions.
PASSPORTS: are required for all U.S. citizens traveling abroad. Due to TSA Secure Flight requirements, you must enter all traveler names on your reservation exactly as they appear on each traveler’s passport, including titles such as Jr. or Sr. and any multiple first, middle or last names.
If inaccurate information is provided, airlines and other suppliers may charge penalties to make corrections or even deny boarding.
Any changes in names or passport information should be reported to us immediately via email. Any name changes or changes in passport information after you complete your booking may result in additional fees at the traveler's expense. It is strongly suggested that traveler's check with the respective consulate(s) or visa agency to determine whether any visas or passports are required.
VISAS: A visa may be required for certain international travel and is the traveler’s responsibility to insure the proper documents are submitted on time and a visa is obtained prior to the traveler’s departure date. Many countries require passports to expire 6 months post travel and 1-2 blank pages.
VACCINATIONS: Vaccinations may be required for many countries visited on our packages. This can also change at any time. It is the responsibility of each traveler to comply with the entry requirements and to secure the proper vaccines and/or paperwork for entry.
FAILURE TO OBTAIN THE APPROPRIATE DOCUMENTATION: does not negate the Terms and Conditions and any extra costs incurred for rerouting due to travel without the necessary documents will be your responsibility.
DOCUMENTS: Provided full payment is received no later than your Final Payment Due date, documents will be sent via email 21 days prior to the onset of services. If paper documents are requested when e-documents are available, documents will be delivered via FedEx approximately 14-21 days prior, and a fee of $30 will apply. A complete street address is required (no PO boxes). Document delivery for group travel may differ slightly.
In addition to the terms and conditions listed above, those participating in group travel may be subject to certain group policies, terms and conditions to include, but are not limited to:
TRIP CANCELLATIONS BASED ON ENROLLMENT: We reserve the right to cancel any Trip or Activity because of inadequate enrollment that makes the Trip or Activity economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the Clients. If we cancel a Trip prior to departure, the Client will be provided with a full refund of monies paid to us; except in the event that the cancelation is due to a significant event that makes it infeasible to operate the Trip as planned, in which case the Client will be provided with a refund and/or credit toward a future Trip equivalent to the amount paid.
TRIP CANCELLATION FOR REASONS OUTSIDE OUR CONTROL: In the rare event that it becomes necessary to cancel the trip for reasons beyond our control, such as terrorism, acts of war, strikes, acts of governments, weather, etc. we will reschedule the trip. Trip delays due to COVID-19 fall under this clause. If you are unable to attend the new trip dates you will receive a trip credit valid for 12 months from the date your trip is rescheduled to apply to a future trip.
LEAVING A TRIP EARLY (TRIP IN PROGRESS): If a client elects to leave a Trip in progress of their own volition, the Client will not receive any type of refund. The Client acknowledges and agrees that: (i) the Client shall be solely responsible for Client’s travel plans once Client departs the Trip; (ii) neither we nor the Tour Operator shall have any responsibility for or control over the Client’s safety or activities once the Client departs the Trip; and (iii) the Client will be solely responsible for any and all costs that may arise out of the Client’s decision to not return to the original point of departure from the Trip in progress.
EXCESS/EXTRA LUGGAGE: For group travel, all tours include one large, checked bag, a carry-on bag, and personal item. Should your trip include an intercountry domestic or charter flight, your luggage allowance includes 1 checked bag up to 50lbs. Carry-ons will be at the discretion of each supplier for intercountry flights. Your carry-on dimensions and weight can vary by airline. Details will be provided in your Pre-Travel Documentation. Baggage and personal effects are at the owner’s risk throughout the trip and ANSE assumes no liability for lost, stolen, or damaged baggage. As soon as damage is known, you should contact the vendor to file a claim.
If you require 2 checked bags there is an additional charge of $50 per piece to account for the additional costs charged by the transportation vendors to accommodate excess luggage. You will be invoiced for the excess luggage fee prior to departure.
We recommend using brightly colored luggage tags, straps, or other identifiers to help you locate your luggage upon arrival or to describe it in the event it is lost or misplaced.
HEALTH AND WELLNESS: ANSE does not provide medical advice. Individuals with heart disease, chronic illness, physical disabilities, advanced pregnancy, or mental illness are advised not to participate in these rigorous travel programs without clearance from a licensed medical provider. Please be aware that many of our travel programs may necessitate walking up to 5 miles per day and may include stairs and/or uneven pavements.
TRAVEL MEDICAL INSURANCE AND EMERGENCY CONTACTS: Each traveler acknowledges that medical services or facilities may not be readily available or accessible during some or all of the time during which they are participating in the trip. ANSE highly recommends each traveler to purchase a Travel Medical Insurance policy that includes (1) Emergency Medical Coverage, (2) Emergency Medical Evacuation, and (3) Repatriation of your remains should you perish. A copy should be provided to your travel host, along with an emergency contact prior to departure.
GROUP TRAVEL DOCUMENTS: Provided full payment is received no later than your Final Payment Due date, documents will be sent via email 30 days prior to the onset of services. If paper documents are requested when e-documents are available, documents will be delivered via FedEx approximately 30-45 days prior, and a fee of $30 will apply. A complete street address is required (no PO boxes).
TIPPING: Complete tipping guidelines are provided with final travel documents and on each program's website presentation. For groups, there may be instances where pre-paid gratuities are a part of the travel package for each traveler.
RESERVATION OF RIGHTS AND CHANGES TO THESE TERMS
We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms will be provided to Clients, will be posted on our website and are effective immediately on posting.
The laws of the State of Georgia govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Gwinnett County, Georgia in all disputes arising out of or relating to travel bookings solely with ANSE. Any claim against ANSE must be brought within 12 months after the date of the completion of the trip and not later. ANSE shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. You expressly agree to waive and forego any and all rights to bring any such class actions, purported or proposed class actions, or representative actions.
The paragraphs outlined in these terms operate separately. If any court or relevant authority decides that any of them are unlawful or invalid, the remaining paragraphs will remain in full force and effect.
KNOWING AND VOLUNTARY EXECUTION: I have carefully read these Terms and Conditions and the booking information sections of this document, and fully understand its contents and certify that I am 18 years of age or older. I am aware that this is a release of liability and a contract between myself and ANSE and agree of my own free will.
The payment of the required deposit or any partial or full payment for a reservation on the chosen tour/package shall constitute consent to all provisions of this Terms & Conditions statement.
